1. INTRODUCTION AND ACCEPTANCE

Welcome to Trezor Fine Art Gallery (“we,” “us,” “our,” or “the Artist”). These Terms and Conditions govern your use of our website tfag.co.za and the purchase of fine art photography prints. By placing an order, you agree to be bound by these Terms and the laws of the Republic of South Africa.

3. INTELLECTUAL PROPERTY & COPYRIGHT

4.1 Ownership: All images and content on this Website are the exclusive property of Trezor Fine Art Gallery and are protected by the Copyright Act 98 of 1978.
4.2 Limited License: Purchase of a physical print grants you a license to display the work for personal use. It does not transfer copyright.
4.3 Prohibited Use: You may not scan, reproduce, resell, or use the imagery for commercial purposes or NFT minting without an express written licensing contract from the Artist.

4.4 PRODUCT SPECIFICATIONS & COLOR ACCURACY

  • Media: Prints are produced on museum-grade media, specifically Hahnemühle German Etching (310 GSM) for Limited Editions.
  • Color Variance: Because computer monitors are backlit (RGB) and paper prints reflect light (CMYK/Pigment), slight color variations may occur between your screen and the physical print. This is a standard characteristic of fine art printing and is not considered a defect.
  • Sharpness: Website images are optimized for speed; your physical print will be rendered at full, museum-grade resolution.

5. LIMITED EDITION INTEGRITY

Limited Edition Prints are strictly restricted to the quantity specified in the product description.

  • Each limited print is numbered and accompanied by a Certificate of Authenticity (COA).
  • Once an edition is sold out, it will never be reproduced in that format again.
  • The COA is the proof of your investment; please store it securely.

6. PAYMENT & SECURITY

  • All prices are in South African Rand (ZAR).
  • Payments are processed via PayFast, a PCI DSS-compliant gateway. We do not store your credit card details.
  • Orders are only processed once full payment is confirmed.

7. SHIPPING & DELIVERY

  • Local Delivery (Cape Town): R250.00
  • National Delivery (South Africa): R400.00 – R550.00 (calculated at checkout).
  • International: Calculated based on destination and dimensions.
  • Processing Time: As each print is custom-made, please allow 5–7 business days for printing, curing, and signing before dispatch.
  • Customs: International buyers are responsible for any import duties or local taxes.

8. RETURNS, DAMAGES, & THE “FRAMER’S RULE”

8.1 The Framer’s Rule (Critical Handling): Our prints are highly delicate. To protect your investment, do not unroll the print at home. We strongly recommend taking the unopened tube directly to a professional framer. Trezor Fine Art Gallery is not liable for “kinks,” creases, or oil smudges caused by client handling.
8.2 Damaged in Transit: If your tube arrives damaged, photograph the tube before opening. Notify us at orders@tfag.co.za within 48 hours of delivery. We will provide a 100% replacement for verified transit damage.
8.3 Custom Orders: Because prints are made-to-order, we do not offer returns or refunds for “change of mind.”

9. PRIVACY & POPIA COMPLIANCE

We process your personal information (Name, Address, Email) solely for order fulfillment and legal accounting in accordance with the Protection of Personal Information Act (POPIA). We will never sell your data to third parties.

10. LIMITATION OF LIABILITY

Trezor Fine Art Gallery’s total liability for any claim shall not exceed the purchase price of the Product. We are not liable for incidental damage caused by improper display (e.g., hanging a print in direct sunlight or high-moisture areas).

11. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
